About these terms
These Terms of Use govern your use of medallionhealth.ca and the Medallion client portal (together, the “site”), operated by Medallion Health Corporation (“Medallion”, “we”, “us”). By using the site you agree to these terms. If you do not agree with them, please do not use the site.
These terms cover the site itself. They are not the agreement that governs a health plan. If your company has a plan with us, the relationship is set out in the Plan & Administration Agreement your corporate administrator signed, along with the pre-authorized debit and direct-deposit authorizations. Where those signed agreements say something different from these terms, the signed agreements govern.
Who may use the portal
Plans are available to incorporated Canadian businesses. Portal accounts are issued to people acting on behalf of a company with a plan: corporate administrators, plan members, and their authorized representatives, along with referral agents who have been approved into our agent program.
You may only create an account or submit an application if you are at least 18 years old and authorized to act for the business you name.
Your account
The portal holds health and banking information, so account security matters more here than on an ordinary website. When you hold an account you agree to:
- Provide accurate, complete information when you apply, enrol participants, submit claims, and attest to how participants are paid, and keep that information current.
- Keep your password confidential and never share your login with anyone, including a colleague or a family member who is also on the plan.
- Complete and maintain two-factor authentication, which is mandatory on every account.
- Submit only genuine expenses, with genuine supporting receipts, for people genuinely eligible under the plan.
- Tell us promptly if you believe someone else has used your account or if information in your account is wrong.
You are responsible for activity that happens under your account. We may suspend or close an account, refuse a claim, or end a plan where we reasonably believe these terms or the signed plan agreements have been breached, where information given to us is false, or where continuing would put the plan's tax standing at risk.
Acceptable use
You agree not to:
- Use the site for anything unlawful, fraudulent, or misleading, including submitting a claim for an expense that was not incurred or for a person who is not eligible.
- Try to access an account, company record, claim, or document that is not yours, or attempt to defeat the access controls that keep client health information separated.
- Probe, scan, or test the security of the site, interfere with its operation, or introduce malicious code. If you believe you have found a security issue, please report it to us at admin@medallionhealth.ca rather than exploring it further.
- Scrape, harvest, or bulk-download content or data from the site, or use automated tools against it, without our written permission.
- Copy the site's content, design, or software for a competing service, or resell access to the portal.
- Misrepresent yourself as a Medallion employee, trustee, or authorized agent, or use our name or marks in a way that suggests an endorsement we have not given.
Content and ownership
The site, its content, its design, and the underlying software are owned by Medallion or our licensors and are protected by Canadian and international copyright and trademark law. The Medallion Health name and medallion mark are our trademarks. You may read, print, and share our public pages for your own personal or internal business use, with attribution and without alteration. Everything beyond that needs our written permission.
You keep ownership of the information and documents you upload. By uploading them you give us permission to store, process, and use them for the purposes described in our privacy policy: adjudicating and administering your plan, processing payments, and keeping the records tax law requires. You confirm you have the authority to give us the information you provide, including information about dependents and other plan participants.
Privacy
How we collect, use, store, and protect personal information is set out in our privacy policy, which forms part of these terms. It covers health and banking information, electronic-signature records, what an employer can and cannot see, where your information is stored, and how long we keep it.
Availability and changes to the site
We work to keep the site available and accurate, but we do not promise it will be uninterrupted or error-free. We may change, suspend, or withdraw any part of the site, and we may run maintenance that makes the portal temporarily unavailable. Where a planned interruption would affect claims or payments, we will give notice when we reasonably can.
Fees, plan limits, and program details described on the public pages are current as at the effective date above and can change. The terms that apply to your company are the ones in your signed agreement and the fee schedule in effect at the time.
Third-party links and services
The site links to third-party resources such as CRA publications, and it relies on service providers for hosting, email, and payment processing. We do not control third-party content and are not responsible for it. A link is not an endorsement.
Limitation of liability
This section limits what we are responsible for. Please read it.
The public pages of the site are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Nothing in this section limits our obligations under a signed Plan & Administration Agreement, and nothing in it limits liability that cannot be limited by law, including liability for fraud or for death or personal injury caused by negligence.
To the fullest extent the law allows, Medallion and its trustees, directors, officers, employees, and agents are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, lost data, or lost tax benefits, arising from your use of the site, from any reassessment or determination by the Canada Revenue Agency, or from your reliance on general information published here.
To the fullest extent the law allows, our total liability arising from your use of the site is limited to the greater of the administration fees you paid to Medallion in the twelve months before the claim arose, or one hundred Canadian dollars.
You agree to indemnify Medallion against claims, losses, and reasonable costs arising from your breach of these terms, your misuse of the site, or information you submit that is false or that you were not authorized to provide.
Changes to these terms
We may update these terms from time to time. The current version is always posted here with its effective date, and continuing to use the site after a change means you accept the updated terms. Where a change materially affects clients with an active plan, we will give notice by email or through the portal. Changes to a signed plan agreement follow the process in that agreement, not this one.
Governing law
These terms are governed by the laws of the Province of Alberta and the federal laws of Canada that apply there. You agree that the courts of Alberta have exclusive jurisdiction over any dispute arising from these terms or your use of the site, and you consent to the venue of Calgary, Alberta.
If any part of these terms is found unenforceable, the rest stays in force. If we do not enforce a provision right away, we have not given up the right to enforce it later.
